MARIETTA - An undercover agent for the watchdog group Jobs for Georgians has worked as a bricklayer the past three months on the construction of the new Cobb County Superior Courthouse, and told the Cobb Board of Commissioners on Tuesday he has evidence that illegal immigrants have been employed and paid in cash by a subcontractor on the project.Commission Chairman Sam Olens said that the county would take "immediate action" if the allegations of illegal employment prove to be accurate, but added that right now they are only allegations.Jose Alvarez may have looked like just another bricklayer, but he has been gathering evidence for Jobs for Georgians that he says substantiates the group's suspicions that illegal immigrants are working under the watch of one of the project's subcontractors....

Translation of a Mexico City news story by the National Association of Former Border Patrol Officers reveals that the Mexican Senate wants President Felipe Calderon to send a message to the U.S. asking that plans to continue to protect its border against illegal immigration be dropped. (”Mexican Senate reproaches U.S. for measures against migrants”)According to the report, Barack Obama’s plan to finish part of the virtual fence displeased the Mexicans, as did his failure to cut the number of Border Patrol agents. The Mexicans say that Obama “went back on his promise he made to all Hispanic groups that supported him…” The Mexican Senate claims he is “closing the border,” and is asking the Mexican president to manifest “an estrangement” because U.S. border enforcement is a violation of human rights. (This action by the Mexican Senate went unreported in the U.S.)  Short-Sighted?

Austin Judge Sam Sparks: No Longer Interested in Upholding the Law

An Austin judge is questioning the prosecution of immigrants citing costs as the problem:
 U.S. District Judge Sam Sparks made the comments in an order filed Friday in the cases against three Mexican citizens who were charged with illegal re-entry after being found in Travis County Jail. He wrote that like many of the defendants prosecuted under the federal illegal re-entry law, the men had no significant criminal history. He says it has cost more than $13,350 to jail the three. Sounds like it’s time to replace Judge Sam Sparks and find a judge who is more worried about upholding the laws of our state and our Nation than he is with budget: If you want to know how stupid this idea is, just replace “immigrants” with the criminal of your choice:
  • An Austin judge is questioning the prosecution of child molesters citing costs as the problem.

NASHVILLE — Former congressman Tom Tancredo is the only former federal officeholder working the rooms at the National Tea Party Convention, and he followed up a fiery speech last night with a short address today at a breakout session on immigration run by Numbers USA. He informed a crowd of older-skewing activists that Tea Party-style activism helped sink immigration compromises in the Bush era.“I faced two big problems in Congress,” said Tancredo, “the Democrats and the Republicans. … The only way we got anything done was to go around Congress.” Tancredo pointed at his audience. “This kind of thing translates.” By the end of his tenure in Congress, said Tancredo, “I had to put on my tennis shoes and sprint to the floor to introduce an immigration amendment, because everyone else was doing it.”Roy Beck, the executive director of Numbers USA, made the case that stopping illegal immigration was the key to solving most of America’s economic problems. “We imported the health care crisis!” said Beck. “Every year we import one to one and a half million immigrants, and most of them go on welfare.” Beck provided cards with graphs that purported to show how illegal immigration was at the root of America’s biggest problems, and proposed five fixes: Rep. Phil Gingrey’s (R-Ga.) HR 878, which would ban chain immigration; Rep. Bob Goodlatte’s (R-Va.) HR 2305, which would end the lottery; Rep. Heath Shuler’s (D-N.C.) SAVE Act (HR 3308); employment visas; and a SAVE system in general.

Where is the person who established the business? The leasing agent paused. The businessman was trying to set up the office a year ago, she said, but he never did. Actually, she added, he used the place only as a mailing address. Bingo. According to immigration official Rand L. Gallagher, the visit confirmed his suspicions that the Chinese national in question had filed a fraudulent application for a business visa. The visa petition claimed the El Monte office housed employees who were going to start a U.S. subsidiary of an import-export parent company in China.

Migrant held in death of farmer who'd laid him off

Grand Rapids, MI (AP) -- A migrant worker is jailed without bond after police say he fatally shot the west Michigan fruit farmer who had laid him off. Kent County Sheriff's Department records show 57-year-old Socorro Hurtado-Garcia approached deputies Friday night and told them he had shot 50-year-old Edward Rasch once in the chest. Deputies found Rasch's body inside the work camp trailer where Hurtado-Garcia continued living after being let go from work in December. Hurtado-Garcia, a Mexican native living legally in the U.S., was being held without bond in the Kent County Jail following his arraignment on one count each of open murder and using a firearm in commission of a felony. He faces life in prison if convicted as charged.
Jail records didn't indicate whether he had an attorney. . . .

Edinburg, TX -- Hidalgo County commissioners approved a resolution Tuesday recognizing the contributions of immigrants to the Rio Grande Valley and offering their support to comprehensive immigration reform efforts.Citing the $400 million that immigrants contribute to the state's economy, the resolution calls for change to immigration policies that cause 'great anguish to county residents who daily experience the tragedy of families divided by ineffective laws.' The resolution was approved in advance of a state convention by the Reform Immigration for Texas Alliance where the group will ask Congress to pass legislation that provides a pathway to citizenship for undocumented residents, creates safer communities along the border and establishes a new workers' program.

The indigenous language, understood by few interpreters, has stymied court cases across the country. One interpreting service in Washington resorted to recruiting a Mam speaker out of a jail lobby. In Hillsborough Circuit Court, two cases, both too serious to dismiss, are stalled for lack of a Mam translator. In one, a 4-year-old Wimauma girl was raped. The details are locked inside her mother, who speaks only Mam. And last year, Pablo-Ramirez was convicted and sentenced to life in prison, before the judge granted a motion for retrial. The court could provide only Spanish interpreters. ...

That tally is well under what the law's supporters say they expected. State Sen. Bill Ketron, R-Murfreesboro, the act's sponsor, said he wants labor officials to explain to the legislative Fiscal Review Committee he chairs why they're not doing more to enforce the act. 'I'm very disappointed in that,' he said. 'The Department of Labor is not doing as the General Assembly instructed.'

The 10th U.S. Circuit Court of Appeals on Tuesday upheld much of an injunction against Oklahoma's anti-illegal immigrant law, ruling that business groups had legal standing to challenge it. That ruling could be at odds with a 9th Circuit appeals court ruling that upheld an anti-illegal immigration law in Arizona. Lawyers trying to overturn the Arizona law hope the differing rulings will make the Supreme Court more likely to step in and create a uniform interpretation.

Oklahoma ruling could affect Utah immigration law

A court ruling on an Oklahoma immigration law isn't a clear victory for opponents or supporters, but it may eventually lead to changes in Utah's immigration law. The 10th U.S. Circuit Court of Appeals, which covers both Oklahoma and Utah, ruled on two of the Oklahoma law's provisions that also are in SB81, the bill passed by the 2009 Legislature that enacted Utah's comprehensive immigration reform. The appellate court allowed Oklahoma to require state agencies and state contractors to use the E-Verify system -- a federal electronic database that matches Social Security numbers to identification documents -- to check workers' legal status, but it deemed that federal law supersedes a provision punishing employers who let go an authorized employee while keeping or hiring an undocumented worker for a similar position.

Elizabeth Frost told her patient at La Clinica to go to the emergency room three times. His heart condition was serious, but the patient, an undocumented immigrant, was afraid of being deported. In the end, a visit to Regions Hospital was unavoidable.
The patient underwent a quadruple bypass, but the procedure came too late. He died three weeks after Frost’s initial warning.
The paralyzing fear of being deported is a dangerous deterrent for uninsured, undocumented immigrants in Minnesota.

'But it's a shame that it took a tremendous amount of public outcry and a federal probe to bring these changes.' Suffolk police have issued orders outlining how officers should use interpreters, notify the public of language assistance options and provide written materials in languages other than English.

Supervisor David Campos on Tuesday requested a hearing on the Juvenile Probation Department to hold the department accountable for choosing not to stop reporting illegal juvenile immigrants arrested on felonies to ICE for deportation proceedings as called for by recently approved city legislation. As was reported in the Examiner’s Tuesday edition, Campos is not happy with the department’s unwillingness to follow the law approved by the board, which prohibits reporting of juveniles unless they are convicted. That law is supposed to go into effect Feb. 10.

Only four local law enforcement agencies in Georgia — those in Hall, Cobb, Gwinnett and Whitfield counties — participate in the 287(g) program, which is a partnership with the federal Immigrations and Customs Enforcement agency that allows sheriffs and police to process for deportation those arrested who are in the country illegally. Only 67 law enforcement agencies nationwide have 287(g) agreements with ICE. State Sen. John Wiles, R-Kennesaw, said he would like to see more agencies using the program, and this week proposed creating incentives for participation.

    National Geographic Television is running a series on the U.S./Mexico border called " Border Wars."
    We have criticized Nat Geo for not telling viewers why Nogales, Arizona is " A City Under Siege." We also asked why they didn't explain why the Predator B UAVs don't seem to work very well.
    A look at American Border Patrol's mapping of the border fence shows a thirty-mile gap in fencing and vehicle barriers west of Nogales – due mainly to rough terrain. Is this why Nat Geo focused on this place? You bet.
    "Border Wars" shows how difficult it is to chase people down after they cross the border, without asking why we can't stop them from crossing in the first place. They simply didn't want to "go there." If they did, they might have to report that a properly designed fence would stop people and drugs - with the possible exception of that section of the border where they focused their effort.
    "Border Wars" was produced with the full cooperation of the Department of Homeland Security, which spared no expense to give the viewers and "inside look" at Customs and Border Patrol operations; helping Nat Geo boost ratings and make money. DHS got across the idea that the border really can't be totally protected, while avoiding the fence issue; a very cozy arrangement indeed.
    Nat Geo should rename this series "Border Fraud."

Guatemala’s President to promote U.S. migratory reform to Obama
Guatemala’s President, Alvaro Colom, said this morning that he will seek to have his counterparts in Central America to lobby jointly for a meeting or at least a phone call with the U.S. President to speak to him about the migratory reform. The opportunity for Colom to lobby with the regional heads of state will be the “Rio Group” meeting to be held in Cancun, Mexico, next week. (This is the Summit Meeting of Latin American and Caribbean Nations, an organization that excludes Canada and the United States.)
During his “Presidential Dispatch” radio program, originating this time from Washington, Colom said, “We are going to ask our companions and friends, presidents of Central America, to seek a meeting with President Obama or a phone communication, so that he may see that we are united.” Guatemala promotes an 11 point initiative so the United States may be aware of it and may take it into account when the time for migratory reform debate comes around, for which reason he has sought the backing of Central American countries.
Benjamin Monterroso, SEIU (Service Employees International Union) and migrant communities leader in the United States, stated in the same radio program that it is necessary to promote lobbying in the United States Senate because he deemed that the chances of starting the immigration reform debate cannot be after March 21st; otherwise, the issue will be delayed three or four years.

A “semi-submersible” craft nearing the final stages of construction was destroyed by Colombian marines “within the last hours” near Mosquera, on Colombia’s southwest coast. The craft, hidden in dense growth, was 16.9 meters long, 2.75 meters wide and would have the capacity to transport some 7 tons of cocaine. An adjacent shop building and a campground large enough to house 30 persons were both also destroyed. This is the first seizure of this type of vessel this year. Fifty-four semi-submersibles have been detected and “neutralized” since 1993. Twenty of those 54 were found in 2009.
