“Our workers should never report an illegal to INS directly.”
Those are the words of Travis Smith, an assistant general counsel at the Oklahoma Department of Human Services, during a training video for DHS employees. This shocking revelation was the fruit of an open records request made by the Oklahoma Constitution.
When immigration reform advocate Carol Helm appeared on Oklahoma Politics and You, a television program co-hosted by Oklahoma Constitution Editor Steve Byas, she mentioned that DHS employees had told her that it was DHS policy to not report illegal aliens. As a result of this allegation, the Oklahoma Constitution made its open records request on July 28.
“I am requesting copies of any communications made to employees of the Department of Human Services concerning services to persons who are in the United States of America illegally,” Byas wrote in his request. “I am specifically interested if any employees have been told not to inquire if the person is here illegally, and if any employees have been told not to report this crime to the appropriate federal authorities.”
This simple request was received by DHS on August 1, and languished for weeks. Several follow-up phone calls finally produced a response on October 10.
In his response to the Oklahoma Constitution’s request, Travis Smith, assistant general counsel of DHS, wrote, “A great deal of effort is placed on OKDHS employees delivering the best possible services to all persons who qualify for them under the law.”
In a section of the guidelines dealing with the distribution of food stamps, DHS staff are instructed that, “Determinations of immigration status are the responsibility of the United States Citizenship and Immigration Services (USCIS). The Family Support Services Division (FSSD) Food Stamp Section, in accordance with Section 11 (e) (16) of the Food Stamp Act, reports to USCIS the names and addresses of food stamp benefit applicants and/or recipients who are determined to be residing in the U.S. unlawfully.”
The policy continues, adding that, “The worker does not report (A) applicants and/or recipients who are undocumented and appear to be residing in the U.S. unlawfully; or (B) individuals who are not applicants or recipients who are not required to declare their citizenship status.” During the training video, Smith said, “We don’t care” about the status of the mother, if she is only applying for her children. The only time for a DHS worker to call INS (now USCIS) is to verify someone’s legal status for benefits.
A report by the Pew Hispanic Center states that nearly 40 percent of Oklahoma’s foreign-born population is in the country illegally. Somewhere between 55,000 and 85,000 “undocumented” (illegal) persons reside in Oklahoma. This growing criminal activity raises the question as to how a state agency can make it a policy to not report a crime! United States law states that, “No local ordinance, rule, or measure shall stop law enforcement officers from enforcement of this section.” This law was upheld in Southern District Court of NY v. Rudy Guliani in 1996.
What financial benefits can legal aliens receive? Under the old rules, an alien could not enter the United States if they were likely to become a “public charge.” Simply put, a person could not enter the country and become a burden on the taxpayers of this country, or have an inability to sustain themselves without U.S. government assistance.
The Clinton Administration made a wording change in 1996. Now, a person cannot enter the country if they will become “primarily dependent on government for subsistence.” This has proved to provide a gigantic loophole, delivering a virtual cornucopia of taxpayer-funded services to aliens and the children of illegal aliens, since DHS does not care whether a child’s parents are in the country legally or illegally.
Services that an alien can receive that will not make the alien considered a “public charge,” include medicaid, chip, immunizations, prenatal care, food stamps, WIC, school lunch, food pantries, emergency shelters, child care, public housing and job training. These may be considered only supplemental in nature by alien welfare advocates. Social security and unemployment compensation also would not count toward making an alien a “public charge.” Very few government programs would cause an alien to be considered a public charge. According to the training video for DHS workers, the main thing that an alien could not receive under this formula is income maintenance. The training video cautioned that cash welfare, Temporary Assistance for Needy Families (TANF), Supplemental Security Income (SSI) and general assistance may not be “safe” for the alien residing in the United States. They are considered “unsafe” by alien advocates because they might cause the alien to be classified as a “public charge.”
One must wonder what other crimes committed by aliens, legal or illegal, are also not to be reported by DHS workers. What about an illegal alien who has committed identity theft by stealing someone’s social security number? Is that just not their job?
Perhaps this situation calls for an investigation by the Oklahoma Legislature. Oklahoma’s state government should be working with federal authorities to prevent crime, and no person should ever be told not to report criminal activity.
"These employees typically have nowhere or no way to deposit their money," Enlow said.
David Blatt, public policy director for the Community Action Project of Tulsa, said the payroll debit card appears to benefit to those who don't have a bank account.
"At first glance, this seems to be a valuable service provided for a reasonable fee," Blatt said. "This is part of a pretty bona fide effort to provide mainstream financial services to people who are not always easy to market to."
Those "unbanked" customers are paying stiff fees to cash checks at storefront businesses or to wire money to out-of-state relatives, Enlow said.
Enlow said she didn't know of any other bank in the market that was providing a similar product.
Union Bank, which has not yet begun marketing the program, has signed up only two small companies, Enlow said, but expects more employers will be participants.
The program is not expected to generate a lot of money for the bank, she said.
"It's more of an added service, something we want to offer our (commercial) customers," Enlow said.
Union Bank commercial customers can sign up for no charge, Enlow said. Those companies would pay small fees each time they deliver payroll to workers, she said.
At the same time, Enlow said, participating companies can avoid a lot of hassles associated with payroll checks.
"They're eliminating paper check writing, which is time consuming and costly. They're eliminating check fraud, the potential for stolen checks and not knowing when that employee is going to cash the check," she said.
For employees, the selling points are convenience and savings.
The debit card offers one free transaction per pay period, and then relatively small fees for additional transactions. For example, an ATM transaction incurs a $1.75 fee. A point of sale purchase at a retailer like Wal-Mart or Walgreens incurs a 50-cent fee.
The cards also can be used as calling cards and can be upgraded to a VISA-branded debit card. Cardholders also can obtain an additional card, for an out-of-state spouse for instance, and can transfer funds from one card to the other, Enlow said.
"We have a huge population of people in the U.S. that are unbanked," Enlow said. "We want to essentially compete with the other banks in our areas and this is one product that we thought this is an open market."
Union Bank operates a branch in the Capitol Hill area of south Oklahoma City, which has a substantial Hispanic population.
Enlow said that also contributed to the decision to offer the payroll debit card.
"That's a huge target area that I'm trying to seek out," she said. "One problem we've been running into quite a bit is we have a lot of commercial customers who have employees and we are having trouble cashing their checks. We obviously want to cash our customers' checks, but if they don't have proper identification, that's required to cash checks."

OCCC sees large increase in Hispanics

Hispanic students made up 6.2 percent of the student population during the spring 2005 semester, compared to 3.3 percent during the spring 1995 semester.
J.P. Johnson, director of Early College Awareness at OCCC, said the Hispanic student population boom is mirroring the Hispanic population in Oklahoma City.
"The whole Hispanic population is increasing, and it's increasing in Oklahoma City Public Schools as well," Johnson said.
Johnson said the college has been actively recruiting Hispanic students through the GEAR-UP and Upward Bound programs.
These programs encourage students to consider attending college after high school by providing candidates with services, including tutoring, mentoring, and career and academic counseling.
The programs are funded by a federal grant to Oklahoma City Public Schools and seven higher education institutions: OCCC, Rose State College, Langston University, the University of Central Oklahoma, University of Oklahoma, Oklahoma City University, and Oklahoma State University-Oklahoma City.
Oklahoma City Community College offers a program at the Capitol Hill Technology Center where students learn computer skills and English as a second language.
Johnson said about 30 percent of students in Oklahoma City Public Schools speak Spanish at home.
Hispanics are the fastest growing minority group in the state, according to recent statistics from the U.S. Census Bureau. The Hispanic population increased by 5 percent from 2003 to 2004.

Hispanic panel wants probe in teenager's death

A governor's advisory council voted Monday to request an independent investigation into the fatal shooting of a 17-year-old male by a Norman police officer.
The vote came after the Governor's Advisory Council on Latin American and Hispanic Affairs rejected stronger language in a letter drafted by member Guillermo Rojas of Tulsa. He wants Norman police to fire officer Chad Vincent for using excessive force in the Sept. 26 shooting of Richard Sanchez, an escapee from a juvenile justice center who was armed with a pocket knife.
"This case is particularly brutal," Rojas said. "Do you think, guys, we can allow this?"
Cleveland County District Attorney Tim Kuykendall has cleared Vincent of wrongdoing, saying the officer was justified in using deadly force because he believed Sanchez was reaching for a knife.
The officer fired 15 shots at Sanchez, hitting him 13 times, Kuykendall ruled.
"We cannot tolerate that kind of conduct by the police department," Rojas said. "If this wasn't serious I never would bring it to the table."
Board member Giovanni Perry of Norman questioned whether the council has the authority to demand the firing of a police officer.
Member Juanita Vasquez-Sykes of Oklahoma City recommended forwarding the case to the Oklahoma Human Rights Commission and requesting an independent investigation.
"More investigation doesn't mean the department investigating themselves. That certainly is not appropriate," Vasquez-Sykes said.
The council also voted to support the McCain-Kennedy immigration reform bill in the U.S. Senate, which supporters say would protect U.S. borders, allow family reunification and provide a pathway for citizenship for immigrants already in the United States.
The Secure America and Orderly Immigration Act is one of at least 100 bills introduced in Congress this year to solve various immigration problems. Leaders have vowed to try to pass one comprehensive reform bill within a year.
In other action, the council presented awards to Sen. Bernest Cain, D-Oklahoma City; Tulsa Mayor William LaFortune; and Irma Chajecki, an immigration specialist with Catholic Charities of the Diocese of Tulsa, for their work on behalf of the Hispanic community.
"In this time of anti-immigrant bashing and xenophobia, our friends become even more important to us," board member Yolanda Charney said.

Butler County mounts drive to oust illegal immigrants

Less than 24 hours after President Bush announced a national initiative to reduce the numbers of illegal immigrants living in the United States, Butler County officials launched a county initiative to rid the county of undocumented, foreign-born residents.
Friday, Sheriff Richard K. Jones, county Commissioner Michael Fox and state Rep. Courtney Combs, R-Hamilton, announced a multi-tiered program they said is the first of its kind in the country.
Beginning Monday, Jones said he will be requiring a declaration of citizenship from all inmates booked into the county jail.
Combs said he is drafting legislation that will make it a state offense for illegal immigrants to cross Ohio's borders.
Fox is working on initiatives to discourage employers from hiring illegal immigrants.
The three said they began working on the issue six months ago, but shelved it when racial tensions boiled over in Hamilton after a Hispanic man was accused of raping a girl.
In retaliation, two teenage boys set the house on fire, destroying it.
The suspect remains a fugitive police said and may have fled to Mexico.
According to national figures federal officials released Thursday, an estimated 11 million illegal immigrants are living in the United States and another 3 million are expected to enter the country by year's end.
Although officials have no estimates on the number of illegal immigrants living within the county, Jones said that in the past two years more than 600 inmates had been booked into the county jail without Social Security numbers, which he said makes them undocumented persons.
In the past year, 885 foreign born people had been booked into the jail, some documented, some not.
"It cost us $1 million alone to house just those who were booked into our jail without Social Security numbers," Jones said. "It's more likely than not that an adult living in the United States without a Social Security number is an illegal alien."
Under the new booking program, Jones said detectives will double-check the inmate's citizenship information against his or her birth records.
Those in jail on misdemeanor offenses who falsify their information or are found to be illegal immigrants, will be reported to the federal department of Immigration and Naturalization Services for possible immediate deportation.
Those jailed on a felony offense will first stand trial and then face possible deportation.
To force INS officials to take the local measures seriously, the sheriff said he intends to bill the federal government $70 a day for every illegal immigrant housed at the county jail.
"We're not saying we don't want immigrants to come here and try to make a life for themselves in America," Combs said.

NOTE TO ICE (Immigration Customs Enforcement) : A few large corporations fined by YOU will “level the field.” Employers will never stop hiring unless ICE and CUSTOMS stop rewarding them by looking the other way. You notify the press of the large “sweeps” to get illegal aliens out of security sensitive locations, yet you never penalize the employer who certainly is no nit-wit. He knew he was hiring illegals, and knows ICE will not fine him the $10,000 per illegal or 10 years in prison. I guarantee, a few fines of this degree and ICE’s work load will become sooooo much easier.

Wal-Mart halts construction statewide on stores

County Takes On Illegal Immigrants
They are up before dawn in the choking dust of the potato harvest, in the vast farm fields and on construction sites. They are Idaho's laborers.
They are mostly Hispanic, mainly from Mexico and despite their back-breaking work, they're not entirely welcome, CBS News correspondent Thalia Assuras reports.
"The illegal immigration is a weapon of mass destruction," says one caller on a local radio show.
Leading the charge against the illegal immigrant influx is Canyon County Commissioner Robert Vasquez.
"It is an economic attack on the United States," Vasquez, who is of Mexican heritage, explains.
But as Vasquez likes to point out, his grandfather came to the United States legally. Vasquez says illegal workers cost the county millions and, in a legal first, he's turning to the courts to get the money back.
Asked if he thinks Canyon County taxpayers are being ripped off, Vasquez says bluntly, "Well, of course."
Canyon County is suing agricultural companies under federal racketeering statutes normally associated with bringing down the mafia, not migrants.
"I am angry. My country's being invaded and my government is not taking any action," Vasquez says.
The claim: the companies have conspired to hire illegal workers, who drive up the county's medical and law enforcement costs.
"They're bringing in crime and they're also bringing in the gang culture," Vasquez says.
The local jail is overcrowded with a large number of immigration cases.
Noting that some inmates must sleep on the floor, Assuras asks Capt. Robert Munsey of the Canyon County jail if these conditions would persist without the illegal immigration problem.
"There might be a few, but not as many," Munsey says. "It's a problem."
There are up to 35,000 illegal immigrants in Idaho providing cheap labor. They make up a critical portion of the agricultural workforce and without them, some say, the industry could collapse.
"The people I hire in the agricultural industry are not taking jobs away from other people," Canyon County farmer Sid Freeman says.
Freeman's family has farmed here for decades. If the lawsuit succeeds he's worried the big companies won't buy his crops.
"I may be the last farmer in nine generations in America," Freeman fears.
Vasquez hopes to take his crusade to the national stage by running for Congress. That has a lot people around here worried.
"He is kind of the engine for driving divisiveness in our community and hate," says Corrine Tafoya-Fisher of Action Against Hate, a bipartisan political action committee.
But Vasquez says he's a patriot: "I'm not opposed to immigration. I'm opposed to the invasion of illegal aliens," he says.

State keeps track of illegal immigrants

The state of Alabama will more than double the current number of state troopers who can arrest illegal immigrants in a move Gov. Bob Riley made to combat the rising problem of illegal aliens.
“Alabama welcomes those who enter the country legally, but we won’t stand idly by and do nothing when we catch illegal immigrants in our state,” Riley said.
An additional 25 state troopers will begin federal immigration law enforcement training next month at the Center for Domestic Preparedness in Anniston. The course will last five weeks, and in mid-November, those 25 state troopers will join 21 other officers who received this special training in 2003.
An agreement signed by Riley and the U.S. Department of Homeland Security in 2003 made Alabama one of only three states in the country with the authority to use state troopers as federal immigration enforcement officers. The other two states are Florida and Arkansas.
“We’ve been a pioneer in this area and will continue to be,” Riley said.
The 2003 agreement Riley signed allows the state to use state troopers to enforce federal immigration law only after they have gone through special training by the U.S. Immigration and Customs Enforcement (ICE) agency.
The 21 state troopers who went through the training in 2003 may question, detain and arrest illegal immigrants they encounter during the course of their normal duties. ICE pays for the training.
Until Gov. Riley signed this agreement, state troopers who came in contact with illegal aliens had to let them go because the troopers did not have authority to arrest them.
“This left us with a ‘catch-and-release’ problem because federal officials were unable to come and get them,” said Col. Mike Coppage, director of the Alabama Department of Public Safety.
“Today, the men and women of our trooper force who are trained to carry out this important mission are proud to serve as a force multiplier in our nation’s homeland security efforts,” Coppage said.
Many of the illegal immigrants who have been arrested in Alabama had previous criminal convictions including armed robbery, rape and drug smuggling, along with their illegal alien status in the United States. Others arrested in Alabama were charged with such crimes a illegal possession of a firearm, bulk cash smuggling and Social Security fraud.
Since 2003, state troopers have made 145 immigration-related arrests.

The Development Fund- Predictably, would be underwritten "with proportional contributions from all three nations" - meaning, in practice, that the U.S. taxpayer will bear most of the costs. It would be earmarked for expanding Mexico's "infrastructure," a term that encompasses not only highways, bridges, manufacturing plants, schools, and hospitals, but also the enrichment of that nation's unfathomably corrupt political class.
One key revenue source for the DFM (Development Fund for Mexico), significantly, would be the Social Security taxes collected on labor performed by illegal immigrants. Social Security taxes collected from illegals and others who use bogus Social Security numbers are dumped into the "Earnings Suspense File," which as of last spring totaled more than $463 billion.
MEXUS (Mexico-U.S. Business Committee) suggests
that "a portion of this fund, say, one percent annually of the total fund, could be allocated to the Development Fund for Mexico." Once the "guest worker" program (read: amnesty) is in place, those who hire Mexican migrant workers "would be required to pay the equivalent of social security into the Development Fund for Mexico" - thereby becoming tax farmers on behalf of Mexico's degenerate, quasi-socialist elite.------------------------------------------------

DHS and AOL: An Unholy Alliance

Washington- The American-based internet giant, AOL, wholly-owned by Time-Warner, has formed a working partnership with the U.S. Department of Homeland Security to permit unlimited surveillance of the millions of AOL online members, according to a report from the U.S. Department of Commerce.
“AOL works ‘closely with the DHS’ to supply information on any AOL customer and allows agents from these entities ‘free and unfettered’ access to AOL Hq at Dulles, VA for the purpose of ‘watching over and keeping surveillance ’ on the millions of AOL customers,’ according to the report.
The legal basis for this is the recently Congress-approved Patriot Act which permits warrantless searches of persons and property. While information gleaned from delving into personal computer messages is supposed to be kept confidential, it appears that the DHS has exceeded their brief and obtained what appears to be strictly personal information which is then circulated to entities outside the DHS.
The Department of Commerce report also states that news of this surveillance has leaked out and is causing serious concern in the American, and European, business communities who are fearful that trade secrets may be given to other business entities, considered as “friendly” to the Bush Administration.

AOL Madness (Warn Your Friends)
AOL is at it again. This time, it's reading *inside* its members'
emails, and preemptively blocking any messages that contain links to
sites that AOL doesn't want you to see.
Note: I'm *not* talking about simple mail blocks, where a mail is
discarded if it originates from a "forbidden" address. No: AOL is
parsing the content of its members' emails and blocking them even if
they merely *mention* a site that AOL disapproves of.
This happened to my last newsletter issue, when I mentioned a perfectly
valid and inoffensive link: ~codeproject~com . It turns out
that last summer, in July, AOL put that site on its naughty list for
some unexplained reason, and ever since has blocked all emails that even
contain a link to that address.
When my list-host noticed huge numbers of AOL
emails bouncing back, they preemptively sought to find out why, and the
folks at AOL then removed the block--- on that one address.
AOL's mail system is just this side of insane. Not only does it read
inside member emails for links that AOL doesn't like, but--- as we've
reported before--- if AOL members get a little lazy and block a
newsletter like this one, instead of unsubscribing, AOL keeps track of
the blocks. Last time I looked, if as few as 10 readers took the lazy
way out of stopping a mailing, AOL would assume that the mail in
question was spam. In my case, if just 10 AOL users out of 160,000
readers--- that's 0.00006 of my readers--- took the lazy way off the
list, all AOL subscribers would have their legitimate issues blocked for
some time thereafter.
AOL's user-level mail filters are nearly useless because the master
filters discard emails before they ever make it to the users' mailboxes
and the local filters there. That means AOL members can white-list
senders to their heart's content but it will have no effect at all on
the pre-filtering that's done by AOL before their mail ever gets
delivered. AOL's user-level mail controls are a little like those fake
thermostats you sometimes see in office buildings that are meant to give
occupants the illusion of local control, when in reality, a central
system is making all the real decisions.
Noted tech writer Brian Livingston also has been struggling with this,
as he reported. Just look at the jaw-dropping failure rates he found:
I've written many times that Internet service providers (ISPs)
are mishandling the growing menace of spam by imposing crude
"junk-mail filters" that delete legitimate messages without
notifying the intended recipients of that fact.
...AOL "bounced" about 88% of the newsletters that had been
sent to subscribers who use aol.com e-mail addresses. The
problem was also severe at subsidiaries owned by AOL,
including cs.com (which bounced 88%) and netscape.net (96%).
...[AOL's] filter simply deletes huge quantities of mail
without ever delivering it...

If you have friends on AOL, you may wish to tell them about this so they'll know why their email is
so unreliable. Of course, there's no guarantee they'll see your email,
just as there's no guarantee that legitimate subscribers to this
newsletter on AOL will get this issue....
But there's a glimmer of hope: For the first time ever, AOL's
membership has started to shrink significantly. Users are finally
realizing they can get better service at lower costs from other ISPs.
Perhaps if enough members vote with their dollars, AOL will wake up
and meaningfully change its Big Brother-ish ways.

OCTOBER 18 - 2005 ON NATIONAL TV
PRESIDENT BUSH HAS A MIRACULOUS CONVERSION
Our President was FORCING his guest-worker program on America and Congress as little as 1 month ago with amnesty dangling from every word. Now all of a sudden, as of October 18, 2005, he says he is going to expel ALL illegals - no exceptions - and secure our borders; all the while he intends to bring LEGAL migrants in for those jobs “no one else will do” and expedite their background checks - background check responsibility will also probably be outsourced to Mexico.
Miraculous Conversion? Probably not. More likely reasons are:
1. Pressure from Republicans who KNOW they may not get re-elected
2. Pressure from activist groups who won’t be defeated nor deceived
3. Failure to retain Border Agents who are appalled at “catch and release” policy
4. Bush’s damaged ego from Mexico’s “Fox” dictating America’s Immigration Policy
5. ICE failure to keep up with all the terrorist Bush has allowed to enter with HIS failed policies
6. but more likely, it is our President’s effort to deceive the masses with one more immigration bill touted from the White House as “for America’s good.” Since NAFTA failed at keeping illegals in their country with no increases in their low wages, and CAFTA most certainly was another deceiver (remember, if it was so good for America, then why the arm twisting, the prostituting of Congressional leaders, the late night vote with extended hours?)
This is most likely Mr. Bush’s last ditch effort to allow migrants to become card-carrying legalized in order to steal jobs from Americans while appeasing big business employers who refuse to pay decent wages to their employers or medical benefits as well as required FUTA and FICA taxes.
Now Mr. Bush is concerned about our rule-of-law; even though he has not cracked down or fined employers who break U.S immigration laws by flagrantly employing illegals.
Soooooooo, let’s see if it occurs to him to just require the sponsor affidavit to be signed by each employer who insists on hiring a non-citizen migrant. We know that mandating such responsibility on the employer, and not the taxpayer, would really appease big business!
Here's a solution President Bush; an employer can bring in as many foreign migrants as they want as long as they sign the sponsor affidavit that levies the responsibility for the foreign migrant’s medical and/or all acquired expenses on the employer’s bottom line, not on the backs of taxpayers. Sounds like a solution to me!
Mr. Bush - Do your job! Enforce U.S immigration laws and protect American citizens
