GovExec.com: The Senate Homeland Security and Governmental Affairs Committee today approved, on a 7-2 vote, President Bush's nomination of Julie Myers to lead the U.S. Immigration and Customs Enforcement bureau. While Democrats have repeatedly said Myers is not qualified for the position and vowed to oppose her nomination, only two Democrats—Homeland Security and Governmental Affairs ranking member Joseph Lieberman of Connecticut and Sen. Daniel Akaka of Hawaii—attended the markup. The Senate Judiciary Committee now has 30 days to vote on the nominee. Senate Homeland Security and Governmental Affairs Committee Chairwoman Susan Collins, R-Maine, said she expects the Judiciary panel to hold a hearing to "probe on the immigration issues."

I am a victim of our currently unsecured borders. Because people get across without having to prove that they have had all their vaccinations they are spreading disease. I am one of the unlucky folks that crossed the path of one who had Pertussis. I have spent the last year fighting this disease. There are 3 kinds of Pertussis, commonly known as Whooping Cough, and I caught the
worst one. One that doctors have rarely seen in America. They didn't know how to treat it! I have relapsed 3 times and had pneumonia and shingles as complications of the disease. I have been on many strong antibiotics and steroids. I have not returned to work since last Thanksgiving, when I became ill, due to the fact that my immune system is destroyed and I work in a high school. The kids would give me every virus, cold, etc., and I just can't take it. I really miss the kids. I do not mind people coming to America to work and be free if they immigrate legally. I say "Welcome" to these good people. But I do expect my government to protect me from harm. And that means securing our borders to keep out illegals who are bringing us more than crime. From: Mike Cutler Sent: Sunday, October 09, 2005 7:28 PM Subject: Rep Jackson Lee has drafted legislation to help secure our nation's borders I received excellent news Friday evening that I want to share with you. is the ranking member of the House Subcommittee on Immigration Border Security and Claims. When I have testified before that subcommittee I generally have done so at the behest of John Hostettler, the Chairman of that subcommittee, but I have also been called to testify at two of those hearings by Representative Jackson Lee. I have often made the point that I am not interested in the party to which members of Congress belong, only that they act in the best interests of our nation, especially where our national security is concerned.
At the last couple of hearings at which I have testified, MS Jackson Lee has told me that she wanted to work with me on the critical issue of immigration fraud and related areas of vulnerability. Consequently, I have been working with her counsel, Nolan Rappaport to address some of these issues. I have also been working, as I am sure you know, with the counsels from the 'other side of the aisle' on a number of these issues and I am extremely gratified that they are all willing to consider my perspectives as they work to make our nation more secure against terrorists, drug traffickers, gang members and other criminals who pose a threat to our nation's safety and the safety of our citizens. All of these folks are hard working and truly dedicated to doing the â?oright thing.â?
Friday evening I received an e-mail from Nolan that had, as an attachment, the proposed bill that he has been working on at the behest of MS Jackson Lee. I was extremely happy to see that some of my recommendations have been addrressed in the bill. The bill focuses on a wide variety of issues concerning the enforcement of the immigration laws, including major support for our beleaguered Border Patrol including body armor, weapons and much more jail space to help curtail the madness known as "catch and release" where aliens who are from countries other than Mexico are permitted to head for the interior of the United States. You will see all of these provisions when you review the bill (it is attached to this e-mail).
I am going to highlight some of the provisions of Title IV here, because it is this section that addresses some of the recommendations that I have made, both during my Congressional testimony as well as in discussions with the counsels of the Immigration Subcommittee. The bill calls for foreign language training (Spanish) to help the law enforcement officers be more effective in conducting field investigations. This language had been a mandatory part of the curriculum for all immigration law enforcement personnel prior to the formation of ICE, the bureau of Immigration and Customs Enforcement under the newly created Department of Homeland Security. This language requirement simply will cause the training to revert to the prior practice and provides incentives for acquiring foreign language proficiency. This title also addresses the critical need for additional agents (at least one thousand) to specialize in going after those who produce and sell fraudulent documents to enable aliens to illegally enter the United States or remain in the United States thereafter. Additionally, these special agents will also focus on those who engage in fraud schemes to circumvent the immigration laws by engaging in such schemes as marriage frauds and securing labor certification fraudulently.
Additionally, this section call for the creation of a task force that will seek to target fraudulent identity documents to better enable law enforcement officers from a wide array of agencies to identify such documents to help prevent such documents from being used by terrorists and criminals from successfully embedding themselves in our country. These measures are reasonable and appropriate, especially in light of the findings of the Presidential Commission on the Attacks of September 11, 2005 and the follow-up report that was prepared on the 911 Commission Staff on Terrorist Travel. According to this report, the 19 terrorists who so brutally obliterated nearly 3,000 lives were found to have used some 364 false identities in order to â?~hide in plain sight.â?T The reports made the point that in order to attack our nation, the terrorists needed to travel frequently and extensively.
When we provide criminals with lawful immigration status in the United States, we not only facilitate their travel into the United States, we also make it easier for them to gain access to the borders of many other countries including our closest allies who honor our resident aliens and citizens when they encounter so-called â?~green cardsâ?T and especially passports issued by our government. They treat these documents as the â?~gold standardâ?T of travel documents. It is critically important that these documents be issued in a process that justifies this perception. The provisions that the bill proposed by Rep. Jackson Lee represents, in my opinion, a significant step in the right direction to help weed out fraud, that according to a report that was issued by the GAO in January 2002, was (and remains) a pervasive problem within the immigration benefits program.
Counterfeit identity documents are another area of great vulnerability for our nation. As I have often said, when a decent person gets up in the morning, he or she generally goes through his (her belongings) to figure out what he wants to wear, while a â?~bad guyâ?T goes through his stuff to figure out who he wants to be! Generally security personnel who are responsible to determine whether or not to give a person access to a train, an airplane or a secure building is the name that appears on the documents that they proffer. It is therefore critically important that these documents have real integrity and that information concerning false documents be efficiently and effectively communicated to those who need to have this knowledge. It is also essential that there be sufficient numbers of special agents who can conduct investigations aimed at identifying those who produce and sell fraud documents so that they can be arrested, prosecuted and consequently be put out of business.
The bill addresses a number of the concerns I have about areas of vulnerability that desperately need to be addressed to help to protect our nation and our people especially as we prosecute a war on terrorism. I look forward to continuing to work with members of the House Subcommittee on Immigration and Border Security and other legislative committees to continue to improve our security. I commend MS Jackson Lee for her leadership in drafting this bill.
