Myth # 1
“It’s always been part of the Constitution”

THE TRUTH:

Birthright Citizenship was added to the Constitution by the 14th Amendment which was ratified in 1868 as one of the post-Civil War amendments (known as the Reconstruction Amendments). 

The amendment was first intended to secure rights for former slaves. It includes the Due Process and Equal Protection Clauses among others.

The citizenship clause of the 14th Amendment says that, “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States…” 

When Congress debated this clause in 1868, Sen. Jacob Howard, one of the authors of the Amendment, made clear: “This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to families of ambassadors or foreign ministers accredited to the Government of the United States….but will include every other class of persons.” 

Birthright citizenship was never intended to be granted to the children of illegal aliens.

We urge you to join us and cosponsor H.R. 1940, the Birthright Citizenship Act. This bill does away with the practice of automatic birthright citizenship for illegal immigrants by providing that a person born in the United States shall be granted birthright citizenship only if they are born of parents, one of whom is a citizen or national of the U.S., lawfully admitted for permanent residence in the United States, or an alien performing active service in the armed forces.
